What's different in West Virginia
The West Virginia Division of Motor Vehicles publishes its own bill of sale, form DMV-7-TR, and its forms page says of that form, “Completed by both the buyer and seller. Must be notarized.”
On the title, the DMV's titles page says vehicles without active liens may be titled and registered by mail, in person at any DMV Regional Office, or through authorized private license services. The DMV's Application for Certificate of Title (DMV-1-TR), which the forms page describes as a title application used anytime an out of state vehicle or any regular vehicle (not rental or lease) without a WV title is submitted, has a fee table that lists a $15.00 title fee among other fees, such as a lien fee of $10.00 per lien, if applicable. For mileage, the titles page says the exact mileage must be recorded in the assignment section of the title by the seller when a motor vehicle is sold or transferred, and that Form DMV-TM-1 is used if the title format lacks this section. The titles page's table of odometer disclosures by vehicle class lists the classes exempt from disclosure.
On a private sale, the titles page says the 6% titling tax is assessed directly on the declared purchase price where the purchase price is above 50% of book value. For a vehicle purchased from a person or business not licensed as a dealer, West Virginia's legislative rule 91CSR9 says vehicles two model years old or less are assessed on the present fair market value as shown in the most recent edition of a nationally distributed and recognized vehicle value guide as determined by the Division regardless of a bill of sale, and it sets a minimum taxable value of five hundred dollars ($500), with exceptions.
