What's different in Louisiana

The Office of Motor Vehicles lists the items for titling a used vehicle, and one of them is an original notarized bill of sale or invoice that specifies the actual consideration involved and gives a full description of the vehicle. Under that item, the list says a separate bill of sale is not required if the selling price is included on the title assignment. The file goes to OMV Headquarters by mail or delivery, or through an OMV office or a Public Tag Agent location. Louisiana law has the buyer apply for the new certificate of title within five days after the delivery of a previously issued certificate of title for the vehicle, or of the vehicle if a certificate of title has not been previously issued. The fees on the list include a $68.50 title fee, an $8.00 handling fee and, where it applies, a local fee of no more than $6.00.

The seller's side is set by statute rather than by the OMV list. Under R.S. 47:510, a person who transfers a motor vehicle shall give written notice of the transfer to the commissioner within fifteen days, on a form provided by the commissioner. Sales tax is paid at the same point as the title: the buyer pays state and local sales taxes to the Office of Motor Vehicles when the vehicle is registered or titled, assessed on the sales price minus any qualifying trade vehicle and rebate. Plates follow two provisions. For a vehicle other than trucks, tandem trucks, semitrailers, tandem semitrailers, trailers, and busses or passenger coaches, R.S. 47:509 says the plates originally assigned to it must remain attached until the end of the current registration year, while R.S. 47:505 says the commissioner may transfer a number plate, as long as the plate remains legible, when a licensee replaces a motor vehicle: the licensee removes the plate and presents it to an OMV field office, which transfers it to the replacement vehicle. If the vehicle is not exempt from odometer requirements and the back of the title has no Odometer Disclosure Statement, a supplemental Odometer Statement goes in with the application. A blank vehicle bill of sale is on this page as well.
